CAM KẾT CHẤT LƯỢNG DỊCH VỤ (SLA) – VPSRE

Thời gian hiệu lực: Bắt đầu từ 07/05/2024

Cam kết chất lượng dịch vụ (Service Level Agreement – SLA) là văn bản cam kết giữa VPSRE và Khách hàng. SLA quy định trách nhiệm, quy chuẩn kỹ thuật và chính sách đền bù của chúng tôi trong trường hợp không đáp ứng được những cam kết này. Chúng tôi luôn mong muốn Khách hàng hoàn toàn an tâm và tin tưởng khi quyết định sử dụng các dịch vụ tại VPSRE.

Các điều khoản chính của SLA:

  1. Cam kết về tính sẵn sàng của hệ thống (Uptime)

  2. Chính sách bảo trì hệ thống

  3. Chính sách bồi thường thiệt hại

  4. Các trường hợp loại trừ trách nhiệm

I. CAM KẾT VỀ TÍNH SẴN SÀNG CỦA HỆ THỐNG

VPSRE cam kết nỗ lực tối đa để đảm bảo hệ thống luôn hoạt động ổn định với thời gian Uptime hàng tháng tối thiểu ở mức 99,9% trong suốt chu kỳ thanh toán.

1. Định nghĩa kỹ thuật

  • Thời gian Uptime hàng tháng: Được tính bằng công thức: (Tổng số phút trong tháng - Tổng số phút hệ thống ở trạng thái không sẵn sàng) / Tổng số phút trong tháng * 100%.

  • Trạng thái không sẵn sàng (Downtime): Là trạng thái mà Máy chủ ảo (VPS/Server) của khách hàng không thể kết nối ra bên ngoài mạng Internet và nguyên nhân được xác định là lỗi từ phía hạ tầng của VPSRE.

  • Lỗi thuộc phạm vi cam kết: Chỉ những sự cố phát sinh từ phía hạ tầng của VPSRE bao gồm: hư hỏng thiết bị phần cứng máy chủ vật lý, lỗi thiết bị mạng trung tâm, lỗi hệ thống lưu trữ (storage) và mất nguồn điện tại trung tâm dữ liệu mới được tính là lỗi từ chúng tôi.

2. Mức cam kết bồi thường

Nếu VPSRE không đáp ứng được cam kết Uptime 99,9%, khách hàng sẽ được đền bù phí dịch vụ theo bảng dưới đây:

Thời gian Uptime thực tế (Hàng tháng) Thời gian gián đoạn (Downtime) Mức phí dịch vụ đền bù
Từ 99,0% đến dưới 99,9% Từ 43 phút – 432 phút 10% phí dịch vụ tháng đó
Dưới 99,0% Trên 432 phút 30% phí dịch vụ tháng đó

Lưu ý:

  • Phí đền bù được tính dựa trên giá trị gói dịch vụ của tháng xảy ra sự cố (không bao gồm các dịch vụ bổ sung hoặc phí cài đặt).

  • Phí đền bù sẽ được cộng vào Số dư tài khoản (Credit Balance) trên hệ thống của VPSRE để sử dụng cho việc gia hạn hoặc đăng ký dịch vụ mới.

  • Phí đền bù không được hoàn trả bằng tiền mặt, không được chuyển khoản ngân hàng.

  • Phí đền bù không được chuyển nhượng sang tài khoản khác.

II. QUY TRÌNH YÊU CẦU BỒI THƯỜNG

Để đảm bảo quyền lợi, khách hàng cần thực hiện yêu cầu bồi thường theo đúng quy trình sau:

  1. Thời hạn gửi yêu cầu: Trong vòng 07 ngày làm việc kể từ khi sự cố kết thúc.

  2. Kênh tiếp nhận: Gửi email trực tiếp đến địa chỉ: [email protected]

  3. Nội dung email yêu cầu bồi thường hợp lệ bao gồm:

    • Tiêu đề: Yêu cầu bồi thường theo cam kết SLA – [Tên tài khoản/Mã khách hàng]

    • Thông tin chi tiết:

      • Ngày và giờ cụ thể xảy ra sự cố (Bắt đầu – Kết thúc).

      • Thông tin tài khoản và địa chỉ IP của VPS/Server bị ảnh hưởng.

      • Bằng chứng xác thực: Logs lỗi, hình ảnh chụp màn hình thông báo lỗi (ping/traceroute)…

      • Lưu ý: Các thông tin bảo mật nhạy cảm (password) trong hình ảnh cần được xóa mờ.

Các yêu cầu gửi quá hạn hoặc không cung cấp đủ bằng chứng xác thực sẽ không được giải quyết.

III. CHÍNH SÁCH BẢO TRÌ HỆ THỐNG

Bảo trì hệ thống là công việc kỹ thuật bắt buộc để nâng cấp, vá lỗi và đảm bảo an toàn dữ liệu. VPSRE chia làm 2 loại bảo trì:

1. Bảo trì định kỳ (Scheduled Maintenance)

  • Thông báo: VPSRE sẽ thông báo trước tối thiểu 48 giờ qua Email hoặc trên trang chủ vpsre.net và Fanpage chính thức.

  • Thời điểm: Thường thực hiện vào ban đêm hoặc giờ thấp điểm để giảm thiểu ảnh hưởng.

  • Thời gian gián đoạn: Tổng thời gian bảo trì ảnh hưởng tới hoạt động server của khách hàng trong 1 tháng cam kết không quá 2 giờ.

2. Bảo trì khẩn cấp (Emergency Maintenance)

  • Áp dụng trong các trường hợp nghiêm trọng cần xử lý ngay lập tức (như lỗ hổng bảo mật Zero-day, tấn công hệ thống quy mô lớn…).

  • Thông báo: VPSRE sẽ nỗ lực thông báo trước ít nhất 15 phút qua Email, Điện thoại hoặc các kênh liên lạc nhanh khác.

IV. CÁC TRƯỜNG HỢP LOẠI TRỪ (MIỄN TRỪ TRÁCH NHIỆM)

Thời gian gián đoạn dịch vụ rơi vào các trường hợp dưới đây sẽ không được tính vào thời gian Downtime và không thuộc phạm vi bồi thường của SLA:

  1. Lỗi chủ quan từ Khách hàng:

    • Khách hàng tự can thiệp sai cấu hình, làm hỏng hệ điều hành, mất kết nối mạng.

    • Khách hàng cài đặt các phần mềm gây xung đột hoặc chiếm dụng tài nguyên quá mức dẫn đến treo máy.

    • Lỗi bảo mật do khách hàng để lộ mật khẩu hoặc sử dụng mã nguồn website có lỗ hổng.

  2. Vi phạm quy định sử dụng:

    • Dịch vụ bị tạm khóa hoặc chấm dứt do khách hàng vi phạm Điều khoản sử dụng (Spam mail, DDoS, lưu trữ nội dung cấm…).

    • Dịch vụ bị tạm ngưng do khách hàng chậm thanh toán phí gia hạn.

  3. Sự cố bất khả kháng (Force Majeure):

    • Chiến tranh, hỏa hoạn, thiên tai, lũ lụt, động đất, khủng bố.

    • Hư hỏng đường cáp quang biển quốc tế, sự cố mạng lưới viễn thông diện rộng (ISP) nằm ngoài sự kiểm soát của VPSRE.

    • Yêu cầu phong tỏa/ngắt kết nối từ Cơ quan Nhà nước có thẩm quyền hoặc Trung tâm VNCERT/Bộ Thông tin và Truyền thông.

  4. Tấn công mạng:

    • Hệ thống bị tấn công từ chối dịch vụ (DDoS/DoS) vượt quá khả năng bảo vệ của hệ thống tường lửa tiêu chuẩn.

  5. Bảo trì định kỳ: Thời gian gián đoạn do bảo trì đã được thông báo trước theo quy định tại Mục III.
